was this in Tracy?! no, it was at the Arden Mall in Sacramento. after he was arrested we found out that he had been arrested all over the USA for doing the same thing in malls, and that he also is a registered sex offender. | |

Your car is your private property. But if an officer sees a violation, they don't need a search warrant to act. They need probable cause, and exigent circumstances. Observing a violation gives them both. Any felony charge will allow them to search your car. Depending on the jurisdiction, a misdemeanor may not be enough. A felony means an arrest and they can make and administrative search prior to having the vehicle towed into custody. As a woman, if you are ever stopped by police make sure your purse is on your person. That makes it part of you, not part of the car. Then they need probable cause to know they need to search your purse. Highly unlikely any scenario short of watching you put a gun in your purse is going to give them probable cause. If they ask to search you or the car, you can say no. You should say no. Even if you think you have nothing to hide. I don't want you to think like me. I just want you to think. | |
