Attorney: Pierce will testify before grand jury if asked

EAST RUTHERFORD, N.J. -- Antonio Pierce didn't know New York Giants teammate Plaxico Burress was carrying a gun last weekend until it accidentally discharged, injuring the receiver in the right thigh, Pierce's attorney said Thursday.

"He had no idea Plaxico had a weapon," attorney Michael Bachner said Thursday in a telephone interview with The Associated Press.

Bachner said Pierce would cooperate with authorities and testify before a Manhattan grand jury about the incident if asked to testify, which has yet to happen.

"Antonio has always taken a position that he will be cooperative in the investigation with law enforcement and should Antonio be subpoenaed to the grand jury, and we have no idea that is going to happen, but if he is, he is going to abide by his obligations as a citizen," Bachner said.

Whether Pierce goes before the grand jury is up to the district attorney's office, Bachner said.

Pierce refused to discuss the shooting and its aftermath after practice Thursday. But he insisted he won't be distracted when he plays Sunday against the Philadelphia Eagles as the Giants (11-1) try to clinch the NFC East.

Plaxico Burress turned himself in to police Monday after accidentally shooting himself last weekend.

"This Sunday is no different from last Sunday," said Pierce, who came into the media room right after practice in a sweat-soaked gray pullover. "It is no different from Week 1. It's no different from the Super Bowl game. It's no different from the first game I ever played football.

"When I get on the football field my focus is winning the game, first and foremost, doing my job and helping my team win," said Pierce, who frequently clutched the podium he was standing behind with his gloved hands. "That's what I plan on doing on Sunday."

Although Pierce did take Burress to New York-Presbyterian Hospital/Weill Cornell Medical Center, as he was instructed to do by a Giants trainer, he did not try to cover it up by registering Burress under a false name, Bachner said.

"Other than bringing him to the hospital, he had no involvement in the administration process," Bachner said.

Bachner said he could not comment on a report that Pierce took Burress' gun to his home and later gave it back to Burress' wife, Tiffany.

Without identifying names, police said they wanted to speak to anyone with relevant information about the shooting or the events afterward.

Giants spokesman Pat Hanlon acknowledged Pierce called team trainer Ronnie Barnes after the shooting and that Barnes told Pierce to take the injured player to New York-Presbyterian.

Hanlon said Thursday the Giants alerted NFL security about the early Saturday morning shooting at a Manhattan nightclub, saying the team left it to the league to alert police. The NFL said its security department then did contact police.

But police say the NFL was not forthcoming about the shooting.

Police said the NFL called a detective squad in upper Manhattan between 10:30 and 11:30 a.m. -- not to report the shooting, but to seek information on whether any 911 calls were made in connection with the shooting and whether Burress had been admitted to a hospital.

The highest-ranking member of the police department called was a lieutenant, and was called at home at about 12:20 p.m. Saturday, police said. By then, police were canvassing area hospitals -- acting on media reports, not information from the NFL. Burress, however, already had been discharged.

"The information we were provided was rumored reports of the shooting of Plaxico Burress being reported on ESPN and elsewhere, and not information provided by the NFL," said NYPD deputy commissioner for public information Paul Browne.

The Giants said Wednesday the team trainer sent Burress to New York-Presbyterian because he wanted Burress near the Hospital for Special Surgery, which is located next door, in case the injury to his right thigh required any orthopedic work by team physicians.

The team said Mark Drakos, a doctor from the Hospital for Special Surgery who has treated Giants players in the past, examined Burress after he was paged by New York-Presbyterian. The team said it was a coincidence that Drakos was on call.

When Barnes arrived at the hospital, he asked to see Burress, by name, and was taken to the room where he was being treated. Barnes later learned Burress had been issued a hospital ID bracelet with an alias, and Hanlon said neither Barnes nor the Giants had any involvement with Burress being admitted under a false name.

While Barnes waited outside the room, an attending physician approached Barnes and said Burress had suffered no vascular injuries. She then returned to the treatment room. The team said Barnes did not know the doctor and was not in the room while she was treating Burress.

Dr. Josyann Abisaab has been suspended for not reporting Burress' gunshot injury, as required by law.

Abisaab, who's affiliated with the hospital and specializes in internal and emergency medicine, could not be reached for comment.

Police still want to interview the people at the hospital who treated Burress and did not report the shooting. Even if Burress used an alias, a hospital must report a gunshot wound regardless of whether it knows the true identification of the person.

Burress has been charged with illegal weapons possession, a felony that requires a mandatory minimum 3½ years and a maximum of 15 years in prison if convicted.

Authorities are trying to determine whether Pierce tried to cover up the shooting. Police say Pierce returned to New Jersey with Burress' gun in the glove compartment of his black Cadillac Escalade. Investigators have impounded the SUV to search it for any blood or gun residue.

Pierce is expected to play against Philadelphia, with the Giants (11-1) on the verge of clinching the NFC East and gaining a first-round playoff bye.

Even if the team makes the playoffs, Burress won't be a part of it.

The team fined and suspended Burress for four games -- which accounts for the rest of the regular season -- Tuesday. The Giants also placed him on the reserve non-football injury list, which means he won't be back for the playoffs.

The NFL Players Association, however, said in a statement that it was reviewing the Giants' actions and planned to file a grievance, saying Burress' collective bargaining rights were violated.

"I had a conversation with Plaxico. He was very humble. He was remorseful," Coughlin said. "Obviously that doesn't change anything. But you have to understand that he is part of our team and our concern is with he and his family's well being, and the ability of him to get through this circumstance and be healthy again."

The Giants have filled Burress' roster spot by signing defensive tackle Leger Douzable from the practice squad.

‘Take me to a hospital:’ NFL star’s night out

NEW YORK (AP)—It started as a typical Friday night at the Latin Quarter: exclusive guest list, $200 bottles of Moet champagne and well-dressed clientele lining up to pay a $30 cover charge to party at the swank Manhattan club.

Then a few very, very important people rolled up in a black Cadillac Escalade: New York Giant stars Plaxico Burress and Antonio Pierce. The two sauntered inside, heading for the VIP section amid the pulsing merengue and hip-hop, Burress with a loaded, illegal gun tucked into the waistband of his track pants.

Within an hour, the Latin Quarter would be a crime scene and the center of a drama that has transfixed the sports world and left Burress’ career in jeopardy.

One week later, authorities are still trying to piece together details of what happened that night. But interviews with investigators and those connected to the case paint a picture of chaos, extraordinary secrecy and a frustrating hunt for answers by the police department.

Burress and Pierce showed up at the club at 1:20 a.m. Burress bypassed the line of patrons and got into the club despite the semiautomatic gun in his pants and ordered a drink.

Around 1:50 a.m., as Burress fumbled with the glass in his hand, the .40-caliber Glock slipped down his leg, and as he grabbed at it, he accidentally pulled the trigger and shot himself in the thigh. Witnesses reported hearing a “pop” as his legs started to quiver and the pistol dropped from his pant leg to the floor.

“Take me to a hospital,” Burress said, according to investigators

Despite the gunfire and blood, no one at the club called police. In fact, investigators say, no one reported the incident at all. Not the players, nor the hospital where he was treated, even though the law states gunshot wounds must be reported.

After the gun slipped to the floor, a club security officer grabbed it, unloaded it and held it while Pierce helped his injured, bleeding teammate to the street and back into the Escalade. He helped Burress, shaking from pain, into the back seat. Pierce hopped in the front with an unknown woman in the driver’s seat. As they started to pull away, a club security guard came to the Escalade’s window.

“What do you want me to do with this?” he asked, referring to the pistol, according to police. Pierce threw it in the glove compartment of the Escalade, police said, then called team trainer Ronnie Barnes. The trainer told him to take Burress to New York-Presbyterian Hospital/Weill Cornell Medical Center, about 20 blocks away.

Pierce’s attorney, Michael Bachner, said his client had no idea his teammate had a gun until it went off, and his top priority at the time was to help his friend.

“Given the extraordinary circumstances of that evening, (Pierce) acted responsibly in trying to save what could have been the life of a friend,” Bachner said.

The SUV sped to the hospital, arriving at 2:04 a.m. and Burress was registered under the alias Harris Smith. It’s not known why that alias was chosen.

Dr. Josyann Abisaab was working her normal night shift at the hospital and treated Burress. As the doctor patched him up and they realized the wound wasn’t serious, Barnes arrived and spoke to Burress. At some point, the Giants alerted NFL security officials, saying the team left it to the league to alert police.

But police say the league and the team were not initially forthcoming, stalling the investigation. They have since been more cooperative, Police Commissioner Raymond Kelly said.

“We want people to report gunshots as quickly as possible. We want people to be good citizens. It’s an obligation of all of us to report gun shots,” Kelly said Friday.

Hours passed as the first media reports of the shooting hit the airwaves. Acting on the rumors, police started canvassing local hospitals looking for signs. The NFL says its security department contacted police; NYPD officials say league officials called a precinct about 10:30 a.m. wondering whether anyone made a 911 call related to the shooting, but provided no details.

By 1 p.m. Saturday, Burress was discharged and on his way to his Totowa, N.J., home. Pierce went back to New Jersey as well, boarding a 1 p.m. team flight for Washington.

At the same time, police were hunting for clues about the mysterious shooting. They were learning details from media reports and not getting answers. Police say the NFL called fishing for information at one point, but didn’t divulge any details about what they knew.

Finally, at 2:30 p.m., they learned Burress had in fact been hospitalized. But details beyond that were fuzzy.

The frenzy over the shooting intensified Sunday.

Burress laid low as Pierce and the Giants took the field in Washington against the Redskins, beating their division rival 23-7 on a dreary, rainy day.

All the while, reporters gathered outside the New Jersey home of Burress’ lawyer, Benjamin Brafman. Burress’ attorney announced his client would report to the 17th Precinct.

He arrived at the precinct Monday morning, surrounded by reporters and fans snapping pictures with cell phones. He was booked, led away in handcuffs, taken to the courthouse and arraigned on charges of criminal possession of a weapon. He pleaded not guilty, posted $100,000 bail and left.

“He is standing tall. He is a mature adult,” Brafman said at the time, stressing his client is innocent until proven guilty. “I think any professional athlete in this situation would be concerned.”

The Escalade was impounded earlier in the week as police searched for blood and gun residue. Police sought out Pierce to find out what he knew and whether he tried to cover up the shooting.

The story was front-page news almost every day throughout the week and became a bit of a fixation with Mayor Michael Bloomberg, who has waged a relentless fight against illegal guns. He expressed outrage on several occasions at Burress, the team, the league and the hospital. He even cracked a joke about the safety of being around the Giants.

On Friday, police questioned the doctor who treated Burress. They also spoke to Pierce, who met with investigators after practicing with the team ahead of the Giants’ home game on Sunday against the Philadelphia Eagles.

Burress will not be on the field, and no one knows when or if he will return.

Suspended for the remainder of the season, the 31-year-old faces a felony weapons possession charge that requires a mandatory minimum 3 1/2 years in prison.

Many questions remain unanswered: What else happened that night that hasn’t been revealed? Will Pierce face charges? Will Burress be able to avoid time behind bars? And will he face additional suspensions next year?

That decision will be up to the NFL, whose office is just a couple blocks from the nightclub where Burress’ career might have come to an end during a night on the town.

On the pre-game show, Collinsworth broke it down how defenses play the G-Men with Plax and without him - it's like night and day. Dallas & Philly had NO respect for the Giants receivers. We're not going deep in the playoffs without our best playmaker.

I always give Dallas credit. They're the one team I fear the most because of their talent. But fuck them and their front-running fans. Have fun dealing with an angry Ray Lewis & Co. smile

How many of those 11 wins was Plaxico there for? My point is that they were winning fine without him. So what's the difference now that he's gone for the rest of the season?

Late in December and in the playoffs, the games become more and more intense. Teams are fighting for their lives, the competition is heated, and as in other sports, your strengths and weaknesses are magnified to another level. You've seen it the past two weeks against Philly and Dallas. We can't run the ball, or stretch the field.

(AP)—The New York Giants need another sack—to cover a flamboyant fan who wears skimpy outfits. Sondra Fortunato went to Giants Stadium last week wearing a Santa Claus outfit, a tiara, fishnet stockings, a bathing suit bottom and high-heeled boots.

She also had a suitcase and two 11-by-17 signs reading “Go Giants” and “Have a No Guns Christmas,” referring to the team’s wide receiver shooting himself in the leg.

She insists nothing naughty was showing even though she’s “well-endowed.” As the middle-aged woman puts it, “You couldn’t even see my underwear.”

The Giants apparently saw it another way.

Security escorted her out, saying signs and baggage weren’t allowed and telling her to cover up because there were children present. She figures other women “got jealous and complained.”

Reports: Weapons, ammo seized at Burress' NJ home

Authorities seized a small cache of weapons and ammunition from the New Jersey home of New York Giants wide receiver Plaxico Burress, the New York Post and Newsday both reported Wednesday, possibly setting up the embattled player for more legal trouble.

The Post, citing anonymous law enforcement sources, said a 9-mm handgun, a rifle and ammunition for three other guns — a .380, a .45 and a .40, the same caliber of gun Burress accidentally shot himself with — were seized during the execution of a search warrant at Burress' home in Totowa.

Benjamin Brafman, the star receiver's criminal attorney, said Tuesday night that he was aware of only a rifle being taken from the home.

"I believe it was registered, but we're looking into that now," Brafman said. "I'm not informed at this time that he is facing additional charges."

If the weapons are unregistered, Burress could face more charges in New Jersey in addition to the two felony gun-possession charges he was slapped with following the accidental shooting at a Manhattan nightclub last month.

"It is not illegal in New Jersey to have a registered weapon in your home," Brafman said.

Burress was not at home during the search by Totowa police, the NYPD and officials from the Manhattan District Attorney's office — though sources said his wife was at home. Brafman said his client is "out of town" but did not elaborate.

Also found in the search — but not seized, since it was unconnected to any criminal allegations — was a suitcase full of money.

Burress accidentally shot himself in the thigh at the Latin Quarter nightclub on Nov. 29 when he fumbled with an unlicensed handgun tucked into the waistband of his sweat pants. He checked himself into New York-Cornell Hospital and later turned himself in to police.

The Giants suspended the Super Bowl hero for the rest of the season following the shooting and also withheld $1 million owed to him as part of his signing bonus.

Burress is due back in court on March 31 and faces up to 3 1/2 years in prison on each count.

Burress was also sued last week in Florida's Broward County Circuit Court for rear-ending a woman in May while driving his nearly $140,000 Mercedes-Benz without insurance.

Compounding the Super Bowl star's defense, according to a document provided by the woman's attorney, is the fact his car insurance lapsed three days before the crash. A letter from Allstate says Burress neglected to pay his premiums.
