Are There Any Lawyers On This Site????? Particularly those well versed in International Law???
A case in point. My son is 21 right now, and lives in the UK, and his father is American and I am British. My son was born in the UK. I have been fighting with my parents and other people who are in the "know" who tell me that my son is British cos he was born here in the UK, but I insist that according 2 International Law, who go by the Fathers nationality, that my son is American!! The reason, I am asking is that when he reached 18, my son should have registered with the US Government, in case the draft was ever reinstated again in the USA, so that he would then b available for the call up(They wont consider him for the draft anyway, cos of my sons medical condition)!! The thing is, they dont do the Registering at the US Embassy in the UK, it has 2 b done at Post Offices in the USA!! My family insists that he is a UK Citizen by birth and that we shouldnt worry about him registering, but I say hes American, so he SHOULD have returned back with us 2 the US and registered!! So, really, what I am asking is this, IS my son American or British?? Where can I go, either personally or online, that would back me up in my claims that my son is American?? Really, I am very fortunate that US Marshalls havent hunted him down and arrested my son cos he hasnt registered and the US Authorities are aware of my sons existance, cos when he was born we had 2 register his birth at the US Embassy, so he has a Consular Certificate of Birth Abroad birth Certificate!!! | |

Even if he isn't british, don't sweat it. The US Govt. isn't really on the search for people that haven't signed up for selective service. Yeah, it's the law, but trust me, they're not worried about it. | |

Dual citizenship is not a bestowed right, by law he is a British citizen as he has 1 British parent and was born there, in order to be protected by US law and be a US citizen he would have had to apply and go through the process. However now he is above the age of consent anyway that would be his choice to apply | |

Then you must have applied for dual citizenship In which case he is under BOTH sets of laws and should be registered. ALL OF THE INFO REALLY HELPS WHEN YOU ASK QUESTIONS | |

If he was born in the UK he has that nationality by birth. If he also has a US passport OBVIOUSLY he is a US citizen too. What's the problem then? | |
