It would imply that marriage or a relationship allows such behavior and there is no legal protection. With enough witnesses neither of them will have to testify to get her convicted. In a wonderful twist of the law, he cannot be forced to testify against his wife, nor can he be asked to. He can choose to by waiving his spousal privilege but can't waive hers.
