Back to the topic at hand: I have never done something like this before! I am not one to tolerate abuse, but I have kids to take care of and have always been able to grin and bear whatever I have to in order to keep bringing in that money. I've never left a job without a better one lined up, and I've always kept things diplomatic in case I need a reference.
In this place, though, enough was enough. I won't go into everything because Chris pretty much summed it up, but I was told point-blank that I was expected to work around the clock, and they backed it up. I was working at all hours, at their disposal, for FREE. Fuck that. I was also constantly blamed for my bosses' crazy mind-changing . Example: "Erin, do Project A in Manner 1." I begin my work. Two days later I am being screamed at. "Why in the HELL are we doing Project A? I have said all along that I want you to do Project B, and why the HELL would I tell you to do it in Manner 1? We have ALWAYS done things in Manner 2 and I have never had a problem! This is BULLSHIT! This is UNACCEPTABLE!" Complete with fists banging on the table, spit flying out of the mouth, the whole nine. Whoa. Under federal labor law, an employer can't get around overtime requirements just by paying an employee on a salary basis. As a general rule, there's a three-part test, and the answer to all three of these questions must be "yes" if the employer isn't paying overtime: 1) The employee must, in fact, be paid on a salary basis, not hourly. 2) The salary must be above a certain amount. 3) The job must be "professional," "administrative," or "executive." State labor laws may provide even more overtime rights. I'd strongly suggest consulting with a lawyer who does plaintiff-side labor law, because there may be grounds for a lawsuit and/or back pay here. Also, this is the kind of thing that the Department of Labor (or whatever it's called in your state) just loves to hear about. Edit: Also, unemployment compensation might be available, despite the fact that this was a resignation, due to the surrounding circumstances. (Disclaimer: I'm a lawyer, but not your lawyer. And I'm probably not a member of your state's bar either. So this is discussion, not legal advice, and for legal advice, you should contact a lawyer in your state. I was like, "No see, it doesn't work like that. You agree on the salary before you start the job, not after you finish it." I am going to try to stick it out until the end of July so I'll have accrued almost 6 weeks of annual leave that they will have to pay for, and until my other co-worker who resigned leaves so that my vacancy will have maximum impact. I am like you--I have never left a job without something else lined up and I am really scared but the stress of working there and dealing with their lunatic asses is making me physically ill. I was finding myself slipping into depression at home, despite my loving and supportive family, and fuck that. You should stick to that plan. I was on the same page as you: One person just quit on them, my co-worker is planning on leaving without notice in August to start school, and I was going to time my exit with hers. I was even planning on giving notice, but it all came to a head and my husband pretty much demanded that I quit on the spot. I didn't argue.
