Prosecutors call Calif. shooting a hate crime

AP updated 4:38 p.m. ET, Thurs., Feb. 14, 2008
http://www.msnbc.msn.com/id/23170485/

OXNARD, Calif. - Prosecutors on Thursday charged a 14-year-old boy with attempted murder and said he committed a hate crime in the classroom shooting of an eighth-grader who was declared brain dead.

Prosecutors would not say why they filed a hate-crime enhancement with the attempted murder count, but several classmates said the 15-year-old victim, Lawrence King, sometimes wore makeup, high heels and other feminine attire.

Prosecutors want the suspect tried as an adult and expect to upgrade the charges after King is taken off a ventilator for organ donation.

"It is inevitable that this is going to become a murder case," Ventura County prosecutor Maeve Fox said.

King was shot in the head Tuesday morning during a class at E.O. Green Junior High in Oxnard, police said. More than 20 other students were in the room at the time.

Fox said she could not discuss the facts behind the allegation of a hate crime because those details of the case have not been publicly disclosed. Oxnard police have not specified a motive but said there appeared to be a personal dispute between the two.

King sometimes came to school wearing makeup and high heels, eighth-grader Nicholas Cortez, 14, told The Associated Press.

Another eighth-grader, Michael Sweeney, said King's appearance was "freaking the guys out," the Los Angeles Times reported Thursday.

It's one of those things where you don't even know what to say. People can't just let each other "be". & there's guns everywhere. & somebody's got something to prove. & the adults are no better examples. & a kid @ 14 is brain dead... because he liked makeup... There just aren't words, man...

sad

I work down the street from where this all happened. It's been rough.
I still cant stomach the fact that all this has happened....
Say it's just a dream...
U open up ur eyes and come 2 realize
u simply imagined this
So u lean over and give her a kiss
Here on earth, here on earth,
with u it's not so bad
Here on earth, here on earth
eye don't feel so sad
Stay right here

I'm sure we all have horror stories. I sure do. neutral

This is just sickening. And of course the local conservative radio station is saying that the people who need tolerance are the closeted gays who act out for fear of their own sexuality. NOPE! It is still on society to not stigmatize us to the point that one becomes that flipped out about being gay, assuming this was a closeted gay teen who did the killing.

All shooting are hate crimes. Has anyone shot someone because they didn't hate them. For fuck's sake, people try to make every discriminitory issue out of everything.
Maybe we can go to the movies and cry together

But if it is a discriminatory issue then what's the problem...?

There's quite a difference in shooting someone because you're pissed at them...angry...your spouse cheated on you...physical abuse...someone hurt your child...someone breaks into your home...

Quite another thing to just shoot them because they are "different" and you don't like it.

Could have been Prince, Little Richard, Annie Lenox...people are insane and it's getting worse.

I see the difference, but I think people should be equally punished - and by equally, I mean very harshly. The guy above is obviously a monster and should never see the light of day.

I'm not saying that people AREN'T such things as discriminatory crimes, but not every crime is.

A white man shoots a black man, and it's a "hate crime". Maybe the white guy didn't shoot the black guy BECAUSE he was black. He just didn't like the guy in general or whatever. Just because there's a interracial crime doesn't mean it's because the perpetrator hated the victim because of his race, disability or whatever.

Maybe the shooter just didn't like this kid for whatever reason. Not saying it's right, and I'm not advocating it, but maybe it didn't have anything to do with the kid "acting gay" or whatever.....

but if he DID shoot the black guy because he was black, then it's a hate crime! how is that so hard to understand?

You're right. Not all white on black/black on white crime is hate crime. Nor do I think they all get categorized as such. Only when the evidence supports it should it be used.

But you seemed to take exception to the general classification. Hate crimes do exist. And there is a reason for treating them seperately from other types of crimes.

I'm not denying they don't exist, but I hear the term used a lot where I feel it doesn't apply. Like when Al Sharpton or Jesse Jackson opens their dumb face holes nod

it's up to the judicial system to decide if a crime is a hate crime or not, not us. prosecutors = part of the judicial system.

Well then what's your point? Like I said, your statement (unqualified) seemed to oppose the application of hate crime law in general. If you agree that hate crimes exist, then what were you opposing in this thread..?

Why the desperation to discount the obvious?

because people don't want to take alook at how their actions or thoughts or opinions on sexuality encourage an envirinment where it is ok to shoot someone who doesn't fit the sexual and gender norms.

like Saturday night at Freemont while it was fun and we all had a great time it was in the back of our mind that someone might attack and we were all on guard and watching everyone.

Really though, the same people that will attack someone because they're "different" are the same psychos that attack their g/fs because they cheated on them.
