Stompy McBitch---Loud Upstairs Neighbor redux Perhaps some of you will remember that CalhounSq coined the perfect term, "Stompy McBitch" in this thread.
Last week I moved into a new apartment and after 3 years of being on the top floor, I now have my very own Stompy McBitch* for an upstairs neighbor. It's taking all the restraint I can muster to not go upstairs and kick her ass! My apartment is not that big--a small one bedroom and this asshole is walking around non-stop! I'm like, what the hell is she doing? Does she have ADD? Doesn't she every just want to sit down and read or watch TV or not move around constantly? She's not wearing heels, but she's a heavy walker and Wednesday night it sounded like she was moving furniture around and hammering shit into the wall. I cut her some slack because it was early evening and I knew I was having people over last night. But today---from 10:30am until now (6:30pm) she's been mcstomping all over the damn apartment! I went out for a couple hours today and thought maybe she'd be done when I got back. No such luck. Then I thought maybe it was a kid--but I don't hear any other voices, no tv, music, conversations; just her tramping back and forth and dropping/moving shit. Since I just moved in I don't want to get off to a bad start as the grumpy new neighbor, but jesus, put a rug down or something. I will give her through this weekend and if it continues tomorrow and Sunday, I guess I'll call the management...or go upstairs with cookies and introduce myself as the new downstairs neighbor and add, "I don't know if you're aware, but I can hear every move you make." (So STFU-hint hint! ) *I'm not 100% sure it's a woman, but I think it is. | |

Yikes! That would get on my nerves too. For some reason, Stompy Mcbitch reminds me of my next door neighbor, Leanor. Leanor comes in and out of her house like an energizer bunny on anphetamines. | |

This is precisely why I could never, ever do apartment living again. I had one of those living above me... I resorted to assholish behavior like throwing shoes at the ceiling. | |

Yes, I re-read my lease and it says that 80% of the floors have to be covered with carpets. (exceptions: hallways, kitchen, bathroom). So I think I am going to go with the "nice neighbor with cookie" option, then try to get a peak in the apt. If I notice no carpeting then I will bring that up when I call the landlord... The only thing is I don't have carpeting in my apartment, so I'm a little hesitant to bring that clause up...but I'm not stomping around constantly, either! In my old apartment the girl below me came up as I was moving out--she said she was surprised anyone lived about her because she never heard me once! Ms. Stomp-Alot was at it all day today too. From 10am--12pm (when I left), then as soon as I got home at 6:45pm, until 8pm when I went out to dinner. Yeah, generally, I'd do the same, but long story short, my previous landlord moved me into this place which he also owns (b/c he's tearing down my old building). It's a better location, nicer place, and he paid me beaucoup $$ to move--so I really (technically) couldn't refuse it. | |

I live in a upstairs apartment and I can tell you this, my downstairs neighbor is a heavy walker and I CAN hear her walking around from upstairs. I asked her one time if she could hear ME walking around ABOVE her. her responce was "No! Your very quite and we cant even tell you and your daughter live up there! The ONLY time I hear you is when you come home from work and I know you have steel toed shoes on." (which no matter how quiet I try and be with steel toed shoes they end up loud anyway).
I remember you telling of the loud neighbor in another thread. But the "neighbor with cookie" idea is good. Or if you have a rug your going to get rid of or not using, see if she wants it.Either way I would find out what the deal is before flying off the handle sort to speak. It’s not easy... being subjected to a noisy neighbor.
Speaking to her\him is a good idea. You can check to see if they have hardwood floors. If they do that’s the culprit. Inform your neighbor of how much noise they are producing. Maybe she\he will be considerate and not stomp. If that fails, inform your landlord and have him\her enforce the 80% wall to wall carpeting. It is the law. If that fails begin to report the neighbor to 311 and ask to speak to the DEP (Dept. Of Environmental Protection) who will forward your complaint to the NYPD. “The more complaints against the neighbor, the quicker the HPD commissioner will have to address the issue”. <=someone from Commissioner Donovan’s office. As of July of this year there are new rules and regulations regarding noise pollution in NYC. The violation amount is $275.00, if I’m not mistaken. I understand your problem because...I live in Brooklyn NY in a large building. There are twenty-two floors and twenty apartments on each floor. There are FIVE tenant-shareholders that have made loud “non-everyday” disruptive noises (drilling, hammering, loud thumps, children running past 11pm, as well as a neighbor with an appliance so strong it’s vibrations are felt thru my apartment floor, when they use the appliance, after 10pm). The folks in one of these apartments now produces daily loud noises from 4:30am until 1am, Sundays through Saturdays. They began June 2005. My guess is that they have a “factory” of some sort. To date...no reply to my Nov. 2007 letter to HPD but it’s too early still. I continue to report most of these neighbors to 311. The “factory workers” get a “Go to sleep JERKS!! (other times it’s Mfers!!; I’m not perfect & for sure it’s better than me breaking their wall down, with a sledge hammer I’ve been hawking for 29mths now).
