Huh? Without state action, there is no First Amendment violation. MTV is a private entity, and it may refuse to air a video for any reason, or no reason at all. Anyway, has it been established that the Mumia Abu-Jamal footage was the reason behind MTV's decision? I suspect that MTV declined to play the video for other reasons (such as, "Most of our teeny-bopper viewers aren't interested in Public Enemy.").
