actually, they are going to be. The release doesn't cover them from something that is a KNOWN danger. For example, if they had to stand on one leg for hours, fell and broke a leg, they're fine.

If they continue to ingest water even though water poisoning is known, the release ain't shit in court. I heard it on the radio today. A lot of people are gonna get fucked over this, and rightfully so.

They knew water intoxication could be fatal. They were told of it by callers to their show. There was a high profile case in California not long before of a college student who died of water intoxication during a fraternity hazing incident. The stations/DJs were the ones in charge, they didn't provide any information to the contestants that it could be fatal, and in fact they took no care whatsoever to ensure the safety of the contestants.

I think it's reasonable to assume that a station wouldn't put on an event like this - given how litigious our society is - unless liability issues had been reviewed first. There was really no reason for the contestants to believe they could be in a life-threatening situation.

The hosts, on the other hand, knew, or should have known, that their stunt could kill someone, and they should be held responsible, IMHO.

Calling the hosts ignorant was wrong on my part. They were fully aware that there was a serious risk.

Technically speaking, everyone involved in this scenario is accountable: those who conceived of the contest, those who okayed it, and those who took part in it.

Realistically speaking, because so much in society nowadays (especially from a litigious and liability standpoint in regards to stunts/contest situations) needs to be examined from the vantage point of the lowest common denominator, the onus of this tragedy lies with the station managers and bosses who either: 1. were negligent and didn't bother to fully research the potential risks and dangers of such a contenst, or who 2. were aware of the risks, yet still chose to put lives in possible jeopardy in favor of conducting a sensational contest which would garner ratings.

There are ignorant people in this world, people who either have little common sense or who choose to employ little common sense and, to be blunt, there are utterly stupid people in this world who sometime require protecting from themselves. Such people are exploited by contests like the one in question, and that's wrong.
