I don't know. There's something so unsatisfying about the whole idea of marrying somebody when I'd have to run off to Canada to do it, and the place where I actually live wouldn't recognize it as real. neutral

I've encountered this kind of weirdness around marriage before, in a different context. . . I'm exhausted by the whole damn thing. Fuck marriage and all of the stupid bullshit that surrounds it.

Except that she hasn't had my cynicism-generating experiences, so she likes the idea. Which is good enough for me. When I realized she was serious ( lol ), I told her that I would love to marry her. mushy

So, could y'all cross your fingers for me that the Washington supreme court decides that my rights are the same regardless of the gender of the person I love?

I have only scanned the majority opinion, but my sense of it is that the case ultimately turned on the standard of review. The Washington Supreme Court applied "rational basis review." Most statutes challenged under rational basis review are upheld; the question is whether the law is "rationally related" to "a legitimate state interest." The court concluded that there are "legitimate interests in procreation and the well-being of children," and decided to defer to the legislature on this issue.

(By contrast, the trial court decisions applied "strict scrutiny." Statutes challenged under strict scrutiny usually get struck down. Under strict scrutiny review, a statute must be necessary to promote a compelling state interest.)

The opinion does have something of a silver lining:

  • The decision is a narrow one. The court explicitly noted that it was addressing only the issue of same-sex marriage. It did "not consider whether denial of statutory rights and obligations to same-sex couples that apply to married couples violates the state or federal constitution." I interpret this to mean that, if the issue were before the court, it might conclude that civil unions must be available to same-sex couples. (While I don't believe that civil unions are an acceptable substitute for marriage, they're better than nothing IMHO.)
  • The court did state that "the legislature may want to reexamine the impact of the marriage laws on all citizens of this state."
  • Although the opinion doesn't actually state this, the issue of same-sex marriage could be placed on the ballot as an initiative/referendum for the people of Washington state to decide.
