Well, I am crying. Ouch. I have only scanned the majority opinion, but my sense of it is that the case ultimately turned on the standard of review. The Washington Supreme Court applied "rational basis review." Most statutes challenged under rational basis review are upheld; the question is whether the law is "rationally related" to "a legitimate state interest." The court concluded that there are "legitimate interests in procreation and the well-being of children," and decided to defer to the legislature on this issue. Under strict scrutiny review, a statute must be necessary to promote a compelling state interest.) The opinion does have something of a silver lining:
