HONEST LEGAL ANSWERS PLEASE!!!

Right, I am British and my husband is American and we have a son, who was born here in the UK almost 20 years ago. He holds a British Birth Certificate as well as an American Birth Certificate and a Consular Certificate of Birth Abroad Certificate issued by the US Embassy in London. I am having loads of arguements with my family and freinds over what Nationality he is both Legally and Constitutionally as well as Genetically!! All my freinds here in the UK say that he is British in every way shape or form!! But my husband and I adamantly say that he is an American, because, after all, the US Embassy is not in the habit of issueing Birth certificates and US Passports 2 anyone of a different nationality, except their own!!!!!

What I am asking, is u guys opinion and answers as 2 what u, as outsiders, think and know regarding what race my son is!!

all that matters is that he is your son. What does that tell us about him ( or anyone else)anyways

Sure we can use the generalizations and if he is "british" then we can call all Brits this or that

if he is "american" we can call him something else

1 parent British, 1 American, but your child was born in the UK, so if anything he's British. Is there any real need to classify him as one or the other though, if it's not affecting his life in any way?

First of all, American and British are not races, they are nationalities.

He can easily have dual citizenship and legally claim both, however if he was raised and schooled in Britian, if you ask him he probably considers himself British.

I believe it should be his choice - and why does he have to make a choice, really?

My Mom has dual citizenship.....and has accepted it for almost 80 years now and gotten along just fine....

Actually, dual citizenship is NOT an easy thing to have. I have a friend that was born in the the UK, her mother american, her father english, lived there still she was 11, moved to the US then and has lived here since. When she turned 18 she had to choose citizenship. The US would not allow her both. She chose to be a UK citizen and got her green card for permanent residency here. She cannot vote hin the US, amoung other things.

If you've got a US passport, I'd say legally you're a US citizen.

i don't think his race has much to do with whether or not he's american or british.

if he has dual citizenship, then technically he's both american and british. It should be his choice as to which nationality he choses to identify with. He could be one or the other or both. It doesn't really matter that much.



that being said, if you really and truly need legal advice, you should see a lawyer, not the .org. we're too silly to answer legal questions with any sort of authority. giggle

It seems you and your friends are talking on two levels. They say your son is British cuz he grew up there and talks the language etc. If he eats beans on toast and is short, red-haired and has freggles it kinda marks him British.
You say that just the passport makes him American. So I think you are talking about two different things here.

I am legally bored with this thread now. Honest.

My daughter, born in France from a french mother and an Israeli father, is BOTH. She could speak both languages from childhood and I think her co-education is a richness. Unfortunatly her father does not think the same and rejected all the french background.

Your son is a dual citizen of the United States and England.

Where a person is reared is that person's place of origin.
1. If your son talks like the Brits, he's not an American, by his cultural upbringing.
2. If your son was educated in England, he's not an American by his primary and secondary schooling years.
3. If your son lived in England from birth to 14 years old, he's not an American by political parties because he has ingrained in him political influences, not of an American upbringing.

Your son is fortunate because the U.S. does not issue dual citizenship to its citizens. If I wanted to become a citizen of England, I would have to give up my U.S. citizenship.

So, if someone wants an argument, just say the following text:

My son is a dual citizen of the U.S. and the U.K., which is rare since dual citizenships are not offered to people with parents of only one of the aforementioned countries. He can live and work in both countries without going through the red tape of getting a visa. However, I consider him a citizen of planet Earth, which is more important than any ONE country.

Make sure your son has a U.S. Social Security Number so he can live, work, and get credit cards in the U.S.
