if you were in this situation, what would you do ?

so, you have a lawsuit that you are working on, right ?


things are going very well in your favor....


you have come up with a person that works for the company that you are going up against. they happen to believe that you were mistreated, and they agree with the lawsuit... so, they give you ALL KINDS of information, shit you would never have known before.... pretty much makes it an open and shut case.


problem - the two of you have become friends, and by letting out the information that you need to to prove your case.... you will in turn get that person fired.


what do you do ?

now, the only REAL way to make sure this gets handled quick and easy is to let out the information that i've been keeping from the investigators..... but, its gonna mean the girl gets in pretty big trouble for sharing that stuff with me sad

Well she knows you are using this info, right? She HAS to know that her name is all over that stuff. WHat has she done to protect her job while helping you? Can she be anonymous? That seems like the only way to go.

Well I would consider a number of things.... Does the girl like her job? Is there going to be enough money from the lawsuit to share with her while she finds a new job? What are you planning on doing with the money? Me personally I would start my own business and ask the girl if she wants to be go into it with me/ hire her after the fact.
Have you asked her why she shared the info with you/ what she wants you to do? Don't assume...

Well they can't fired that person. Thats harassment and they can file suit right after you. But they can get the crap beat out of them by the employees though legally!!!

the only way in which information obtained in this way would ever be admissible is if Naked uses what she's been told to help the attorneys draft discovery requests that will eventually obtain the information through acceptable channels.

anything else is hearsay, or if actually stolen from the corporate entity, will be simply inadmissible.

ok, heres the deal sigh i was gonna wait before i said anything... but, i might as well let it all out....

the reason i had to move was because i got a notice on my door one day out of the blue saying that they were not going to renew my lease and that i would have to leave. i was shocked and stunned.... i went to the neighbor, a girlfriend of mine, and asked her what the hell this paper was supposed to mean. she answers me with, 'yeah, i got one of those too' eek

turns out.... the property is redoing a lot of things around there, they are.. as i was told a week earlier by a worker that i THINK was trying to give me a heads up - 'taking out the trash'... meaning, getting rid of 'undesirable' tenents. now, mind you, im no dummy.... but when the man said that to me, i assumed it had nothing to do with me since i have never been late on my rent, i have never had police called on me, i have never had a complaint within the apartment complex either with the office or my neighbors. infact, all summer long while the kids and i were at the pool, the office folks hung out with me outside during their smoke breaks. at one point, some children had done damage to the property... the office sent the police to MY door hoping to interview my kids because they said they were very trustworthy children.

anyway... the folks that have gotten a notice to leave, all of the reasons vary a bit, but the one thing that we all have in common is that either its an african american family, or a white woman with bi-racial children.

sooooo, i made calls, A LOT of calls.... and i got the HUD office involved. now they are being looked into for discriminatory behavior.


the woman that helped me out, shes the assistant there.... and i have NOTHING against her... i need to let out the information so that the investigation goes smoother.

btw, yet another family was asked to leave just 2 days ago, so this silly bitch up in the office is neither fair, nor bright.... because, when im done with her - she wont have a job at all !

thats exactly it, i have to give my final deposition soon.... and they will be asking me all kinds of questions (i think thats what thats called, you know where they type everything you say word for word ?)..... the time has come to let the info out, and gather witnesses.

i hate that she is in the middle of this, but she is young, and i dont think she really thought about what it would mean to HER in the end sad

yeah, talk to the girl about possible outcomes
if the company is that dirty then she would probably be happier getting out of there - if it was her decision to leave rather than it being forced upon her as a result of her actions that makes the world of difference

OK so you really have nothing to worrry about. She should never had said anything. And you have every right to report stuff like that. It'll end up as hearsay in court if she refuses to stick behind them. BTW...they can't pick and choose folks to move out for renovations...It should be the whole complex...but that's legal, as long as they are really doing the renovations. One can always keep a look out to see if anything was really done. And if not, you def have a case (sounds like you do already)

no, the renovations they are speaking of are... new bushes, new flowers, new cable company and internet service included in rentals, new parking lot.... this type of thing - no structural remodeling of any kind.

and yes, they are definately picking and choosing nod thats where we have a personal problem - and to be honest, im pretty fucking pissed about it !!!

How long did you live there before you received notice on your door?

Anyway... I'd either talk to my friend and ask them if I could use the information in my case and if they said that they'd prefer I didn't then I wouldn't use it. It'd depend on if I really valued their friendship or not. If I did, and they said no, I would act as if I never received that info.

To be honest though, and I don't know all the circumstances, other than what you said in a post or two here but, based on that, me personally, I wouldn't have thrown a lawsuit up against these people/company. I'd chalk it up to people can be assholes and move on.

I dunno... where I live, a landlord can choose to not renew your lease based on absolutely nothing. They have that right, plain and simple. But again, that's here where I live.

Not necessarily. It may fall under the hearsay exemption for "party-opponent admissions." See Federal Rule of Evidence 801(d)(2)(D). Many (most?) states have used the federal rules as the model for their own evidence rules.

However, here in Washington state, they modified this rule, and it's harder to get such statements into evidence. Basically, in Washington, to get these statements in under the party-opponent admission exemption, the co-worker had to be authorized by the company to make the statement(s) on the company's behalf. Washington ER 801(d)(2)(iv).

Bottom line: it depends upon 1) the court (Federal or state? If so, which state?) and the surrounding facts.

Of course, all of the above is academic and doesn't answer nakedpianoplayer's question. And in any event, she should talk to her lawyer about it. For starters, this new information may require the amendment of past discovery responses under Federal Rule of Civil Procedure 26(e), or the applicable state's version of this rule.

I dunno... where I live, a landlord can choose to not renew your lease based on absolutely nothing. They have that right, plain and simple. But again, that's here where I live.

i certainly would have just left as well.... UP UNTIL i found out that it had to do with my family !

once i got wind of the fact that the woman was uprooting families over something this stupid... i was all over her ass !
