I'm in a bit of a pickle If someone wrote you out a cheque for a very large sum of money, and then died suddenly before you were to cash the cheque, and they, by mistake, wrote your name wrong on the cheque, and your bank would NOT accept the cheque, how do you go about getting the cheque re-issued? Thanks Wait, what if he has no personal representative/estate executor, or whoever has power of attorney? well, i'm not really qualified to advise but i think if the person dies intestate (without a will and without having appointed an executor) the state's probate laws/procedures automatically govern. the court of the county in which the deceased lived will be where the probate proceedings are filed. i think you would be able to submit a claim in writing, explaining the situation to the court. procedures differ from state to state good luck | |
