Woman forced to lactate by border patrol Posted Dec 4, 2005, 1:12 PM ET by Melissa Summers Related entries: Lifestyle, Media Zayra Cano, whose legal residence is in California, was returning to the United States from a day trip to Mexico with her fiancee, parents and her baby. Cano was breastfeeding in the back seat when the family arrived at the border (eeek! The baby wasn’t in a car seat?). The border guard accused her of child smuggling and told her to produce milk in front of him to prove the baby she carried was actually hers. Cano has filed a complaint and the U.S. Customs and Border Protection says the case is being investigated. Inspectors who suspect a baby’s identity are supposed to ask for a birth certificate, which Cano did supply, can then demand a “second inspection”. Do they think a reasonable “second inspection” is requiring a woman to manually express mmilk for the border guard to view? | |

At a minimum, this likely violates Customs' internal policies, given that the border guard was male. I believe their policies require that even things like a pat-down be done by an officer of the same gender. I think this is unacceptable....to ask a women to squeeze milk out her titties just to prove the kid is hers....it was prolly some horny ass customes worker wanted to see her tits... | |

If this story is TRUE her CONSTITUTIONAL RIGHTS were VIOLATED. Did she do this? I wouldn't have She was a DUMMY. She should have said Call my Lawyer. Since WHEN are ya Gonna do that for a MALE CUSTOMS PATROL? This story CAN"T be TRUE..I Think he is in some SERIOUS TROUBLE HERE. | |

I'm not so sure. Customs can do a lot to you and your stuff at the border. There are limits, though. (Contrary to popular belief, the border is not some sort of zone where the Constitution does not apply.) I can think of at least two Constitutional claims that could likely be asserted in good faith -- violation of 4th Amendment (illegal search) and 5th Amendment (substantive due process violation) -- but it'd be a tough case. I'd either want a lot of cash up front to take the case, or I'd refer them to the ACLU. She should have said Call my Lawyer.

Baby smuggling is all too real. I am not saying I am condoning this behaviour, but it is pretty good proof the kid is yours.
I still have loads of milk, even though I stopped breastfeeding 3 months ago. I could smuggle some babies. I guess it isn't fool proof really | |

What a shameful story...although I am sure that MANY children have been smuggled in here in such a way. The most gruesome story I've heard involved a baby which a woman carried with her on a flight from Columbia to the U.S. It's a very, very, very long flight, and the baby did not "wake up" not once. So the crew became suspicious and notified the authorities upon landing. Did her rights get violated when she was heralded into customs and interrogated and forced to prod her child awake??? Probably. However...in this case, the child was actually a dead corpse which had been stuffed with cocaine. Strange sh*t happens every day. By St. Boogar and all the saints at the backside door of Purgatory! | |
