The death penality never has worked, either as punishment or prevention, and it never will. I hate to get all Mr. Spock on you, but if you try to apply logic to the existence of the death penalty you'll find there isn't any.

imo, the only real argument for the death penalty is one of retribution, or 'justice for the victims', or whatever. if you're talking about removing the threat, incarceration does that. if you're talking about deterrence, there are a million and one studies out there which suggest that the death penalty is absolutely no deterrent whatsoever. Whether people murder others is down to a billion things other than what the possible punishment will be if they get caught. There are studies that support the idea that the death penalty is a deterrent too, but i wouldn't support killing people on the basis that it 'might' work.

oh, i should add that even though i think retribution can be argued fairly convincingly, i don't buy it.
