It is illegal if neither party knows the call is being recorded.

Federal law allows recording phone calls/conversations if one party knows it is being recorded, and most states follow this rule.



Seems weird with all the hubbub of companies always letting you know the conversation is being recorded, since they would be the one party in the convo knowing it's being recorded.

Hmmm, I always thought that both parties are legally required to know the call is being recorded, hence, when you call a company you'll get the auto-message saying, "this call may be recorded for quality purposes...". My friend is a Lawyer and works for the US States Attorney's office - she told me it is a Federal offense in any state (I think) to record someone without their knowledge.

Prince never had a problem suing folks as much as folks liked to sue him, so I guess that was part of the consideration.

Sure, that is certainly possible. She very well may have said, "hey, I might give you a call while I'm on the show...."

I am an attorney.

Okay, but the legal if one party knows it's being recorded" doesn't make sense to me at all.

So, I can record a phone conversation with my friend without his or her knowledge, and I know the call is being recorded. If the friend discovers I've recorded the call, and sues me for obtaining information from that call without his or her knowledge, I won't have any legal repercussions from that lawsuit??

Eh, I got lazy and wiki'd it. It depends on the the country, each country has different laws. In the US it depends on the state. I live in a 2 party consent state so that's what I know. Minni is a single party consent state so he could. Don't remember what country Anna's from.

Seems my state has the strictest policy even if the person recording is from another state or country, it's still a no without both parties consenting. But outside of that, for personal use seems to be okay as long as there is no 3rd party getting involved. I'd assume the public would be 3rd party but I don't know.

Well, if she did record without Prince's knowledge then I guess the entire world is the 3rd party now that she's posted it on YT eek

this reminds me that prince's ebony interview was recorded. some have conjectured that he knew this so he had it pulled. the journalist has come up with some weak ass excuse that he accidentally left his recorder on.

I thought that guy knew his recorder was on. I think he said he hit record on his cell phone and put it in his pocket. No one knew he had it there. He said, no one had asked him for the phone, so he used it for the recording. Really bad form. I think Prince had it pulled as soon as he read it, and knew that it had been recorded. It was out there for a short time before it was removed.

Yes. The whole situation sounded absurd. The guy plays piano and he asked Prince if he could play one of his songs for him. I believe he said Prince looked a bit amused by that, but let him use the piano - he did not stay to listen to him play. Then I believe he said he thought the interview was over, but ended up sitting in one of Prince's sports cars talking to him. He even stated that the sound is muffled, because he had his phone in his pocket. A real low-life. No wonder Prince didn't trust journalists.
