But they Comerica are asking for more time to work on a settlement. If Comerica cannot put its hands on the original contract how are they going to prove it was backdated?

They will need someone who was a witness to the transaction to testify. Maybe Pheadra or the other atttorney that was involved can help by why work on a settlement if you have hard proof.

It is going to be hard to prove and it is about what you can prove. Comerica could be right about the backdating and the POA but they have to prove it and really we know Prince wanted to work with Tidal so does it not make more since to sit down and work something out.

NPG Records, who initially sued Tidal in 2016, allege that an equity term sheet, the contract lays out the terms of Tidal’s agreement with Prince, “was fabricated and backdated to appear authentic.” Additionally, the lawsuit claims that Tidal took liberties with Prince’s music that wasn’t consistent with the language of the term sheet and that Phaedra Ellis-Lamkins, Prince’s manager who negotiated with Tidal, is withholding documents from NPG along with Tidal and Roc Nation in a veritable “scam” to cheat Prince’s estate.

The above is a Motion to Compel Documents/Discovery filed by Comerica in the Federal case.

Tidal has withheld numerous emails and/or redacted documents as November 10, 2017.

Comerica requested the Court to intervene.

Tidal admitted there was no shareholder agreement with Tidal and P.

Well, Tidal hasnt requested an injunction against the Estate for streaming Ps music on other streaming services either. It appears it was Phaedra that gave the go ahead to Tidal after P passed to stream the additional material.

Phaedra isnt a party to this lawsuit. Tidal is. As a party you have a duty to produce documents in your possession to the opposing party. Tidal has these documents in their possession and have to pony up.

This is basic Rules of Civil Procedure.

Tidal is playing games.

Phaedra appears to be worried about liability even though the Estate gave her a free pass as to personal liability. Her feelings are hurt that she was removed as Manager.

I do not think Tidal is making up their own rules they are just not making it easy. Remember Prince came to them for steaming services not the other why around. All the dragging this out by Tidal could be stopped if Comerica just had the music removed as the profit motive would be gone for Tidal.

With AGE live if he decided not to show up for the shows he was not going to get paid and he had no rep for not showing up for concerts.

Prince had more to lose then AGE. I still cannot see Tidal giving away 3 million without some agreement. I also have yet to see anyone answer my question.

If Tidal did not have a signed contract to stream those songs how come Comerica has not been able to get an injunction to get the songs off of the platform?

Do you realize as of last week Comerica's lawsuit was filled a year ago?

It was Bremer who was representing the estate at the time. It was Nov 16 2016 per the court doc. Comercica continued on with the suit when they took over. Your point is what? Breamer or Comerica has not been able to get these songs off of Tidal and now they are working on a settlement.

My point is about being factually correct. The PRN estate is very complex and in order to be able to have respectful, purposeful dialogue about it without there being confusion, the facts that orgers share on threads about the PRN estate need to be accurate. Bremer (not Breamer) filed the lawsuit, not Comerica; Comerica inherited and has continued the lawsuit.

When NPG Records sued Tidal in 2016, was NPG under the control of the PRN Estate and Bremer at that time or was it a separate, independent entity? Is Comerica in control of NPG Records right now?

Is it possible that maybe Comerica did not file an injunction against Tidal regarding Prince's music because the PRN Estate is earning revenue from streaming of Prince's material on Tidal?

Bremer was in charge at that time and Comerica is in charge now.

Okay one more time. Breamer filled the suit because they were in charge at the time. Now Comerica is in charge. Comerica is representing the estate and therefore is capable of getting an injuction to have the material removed since they are in charge now.

Could be as it is revenue and we have no doubt that Prince wanted to work with Tidal. As long as money is coming who cares what platform it is on.
