he didnt lose, his publisher lost, further , it can be they are looking for some sort of precedent either way

First, it's a shame his name is associated with this because it doesn't sound good at all. But it's the bed he made.

It seems like Universal are saying "we look at each video and decide if it's fair use" The opposition is saying "They just do blanket takedowns - because here's a kid dancing to a song on the radio, that's fair use but they took it down".
