I think if he wants to throw it out to someone and then wants it back. He should make it a set up. Put someone that is his posey thats always in the background that ppl don't know, to be on the front row to catch it and make out like its some big thing then when he ask for it back...There isn't any problem. I think its wrong to throw it out, then take it back and give them a pick. "WOW" I got a pick, big deal. At least it could be a signed T-shirt or something like that

I don't wish bad things to anyone including Prince. I leave that for the routine haters. But its funny he's been doing this for a long time and I don't recall anyone being in a hissy fit over it until now. I do agree that Prince should not be throwing things in the audience that could hit and hurt anyone, but its been done before and just as you're claiming Prince to not care no one including myself though about it like that moreso than just adding some fun to the show. If the man sues then he should settle, learn his lesson and leave that out of the show.

[Edited 2/26/11 10:56am]

Ah, there it is. The obligatory Hater remark, reserved for those that have the nerve to think that a grown ass 52 year old, Professional Musician should behave and be responsible as such and dares say he should be held accountable for his actions. Boo freaking hoo!

It's a matter of intention. If Prince doesn't intend for an audience member to catch his guitar and think it was a gift. Then he SHOULD NOT throw it to them! He should stick to throwing it to his stage hands. If Prince intends to just give the audience a thrill by letting them hold his guitar, then he should hand it to them and ask for/take it back, himself. That's not too much to expect of a grown ass 52 year old, Professional Musician!

But since we are talking about Prince and I am such a Hater...it's not too fucking much to expect of a Showman of his exceptional caliber and longevity, to just buy a bunch of cheap ass guitars (I'm certain HE could get a damn good deal on some!) and incorporate them into his shtick and whomever he hands them to (not thows...thereby, preventing any mobbing fam scenes), gets to keep them! No harm. No Foul. And Prince actually getting some good PR off of a business decision/stunt. Well, imagine that! rolleyes

http://kron4.com/Article.aspx?ArticleID=392 North Bay Man Recovering from Injuries Suffered at Prince Concert SAN RAFAEL (KRON) – A North Bay man is recovering from injuries he suffered at a Prince concert Wednesday evening. Perry Litchfield told KRON 4’s Terisa Estacio that while at the concert, Prince gave him his guitar and he’s not happy that stage crews took it back from him. “He tossed the guitar and I caught it. Then I was dragged to the ground, I don’t know what happened at that point. There were a lot of people around me then I realized I was bleeding on my hand,” Litchfield said. Litchfield showed cuts and bruises he suffered on his hand and back. A stage hand then walked over to the man and told him he needed the guitar back. When he went back to his seat, the person who took the guitar from him brought him a guitar pick. When the show was over, Litchfield went to the stage area and asked for the guitar back but was told no. “I really feel like I should have the guitar, I’m not dwelling on the injuries that happened, I’m concerned about the event and about the fact that I should have gotten that guitar,” Litchfield said.

I believe the people who say this doofy looking cuss is just tryna get paid, lol

He should be glad they took the guitar back...he could've caught a real beat down before he even made it to his car with the thing.

Prince should think up another schtick though. What's the big deal of touching his silly guitar anyway?

Look - Yes, in this sue happy world we live in, Prince may want to think twice. A shame he must... I remember when we could just have fun.

But people must realise - unless someone says, "I want you to have this" or "I gift this to you", etc. It is an ASSUMPTION that you get to keep it.

If I hand you the keys to my car, does it mean I am giving the car to you if I do not say anything?

If this guy at the end will get his wish and gets this guitar, then more people will come out to get beaten up in Princes' concerts and get free guitars. I hope this guy will loose in the court if he wants to sue Prince. If this guy wins, then Prince will always get this type of people, who will try to extort him.

Prince Indian Gives Guitar to TMZ Staffer

http://www.tmz.com/2009/0...z-staffer/

Hey everybody, Daniel from TMZ here. So last night Prince gave me his guitar ... and then some guy took it back.

Play video

Daniel at TMZ.com said:

" I was lucky enough to sit front row during a taping of “The Tonight Show.” I was there for one reason, and one reason only — to see Prince. After suffering through Paul Giamatti and Emma Roberts, Prince came on and performed “Dreamer.”

As the song was winding down, Prince took off his guitar and walked out into the crowd — I had no idea what he was doing. He walked right up to me and just simply handed me his guitar and walked away. I stood there stunned for about 20 seconds while my friend Trent went nuts. We both kinda strummed the guitar before I turned around and held it up to the crowd triumphantly.

After another 30 seconds or so, someone came around and retrieved the guitar Now, I was all excited about this whole thing — calling and texting everyone I can think of. But when I came to work today, everyone said the same thing — PRINCE OWES YOU A GUITAR. I believe Harvey’s quote was, “You’re a schmuck for giving it back.”

Not everyone just KNOWS that is some ridiculous part of his act. It is very LOGICAL everywhere but in Princeland, apparently...to think that if someone hands/throws you something (no matter what it is) without saying anything like "Hold this for me." then turns around and walks away...that they just GAVE it to you!

I know love is blind but Prince-love seems to be blind, deaf and dumb! disbelief

I knew from the start that I loved you with all my heart.

I purchase coffee all of the time on the go, and I've never seen such labeling. Where did you come across it?

Personally I haven't, which is why I said I'd be happy to be corrected, but I heard this was the case after the woman successfully sued McDonalds over this - initially for over $2M (eventually reduced to $640k) - back in 1994 (http://en.wikipedia.org/w...estaurants).

However, after googling to get a reference for it, I found another website (http://www.talkaboutcoffe...myths.html) that was supposedly debunking the myths around the case and saw this:

Myth #2: There was no warning on the coffee cup.

Actually, the cup was marked with a warning that the coffee was hot. The jury, however, felt that the warning was neither large enough nor obvious enough.

Awesome.

I trust the woman who tried to sue Starbucks because their warning was too small and she was dyslexic and thus had a car accident because she was trying to read it while driving was unsuccessful (http://scrapetv.com/News/...-side.html), but I didn't investigate.

Quite frankly, I don't want to know.

It is true, I have bought coffee and there is a warning near the top of the cup rim that says "Caution: coffee is Hot"

I believe it is McDonalds and if that is correct their coffee IS hot. Tim Hortons coffee is never hot...you can slam it right away, the temp is slightly warmer than room temp.

nod Considering what some witnessed while there, this guy's story doesn't seem to hold a lot of water. We shall see what comes out of this, if this guy plans to take it further. According to some witnesses, when he caught it, he held on to it for dear life and didn't seem to be that concerned about getting hurt in the process, when he fell to the floor or he would have let it go. Damn fool.

Can't believe it. Prince doesn't have the guts to release all his great unreleased music, but he has the guts to throw his guitar at some pansy that looks like he would get his ass kicked by Elton John. Perhaps Prince should give the guy tickets to his next Bay Area show and say he is sorry, but even if Mr Pansy thought he could keep the guitar, he should have figured it out.

possession is 9/10th of the law.

If Prince was suing the man to get the guitar back then maybe... but the fan returned the guitar.

To me that indicates that the man KNEW that the guitar did not belong to him but in fact belonged to Prince. In order for the man to sue for the guitar wouldn't he have to prove that Prince promised the guitar or contracted to give it to him or something like that. He doesn't have that so no case.

He could sue for unsafe environment but that should be directed to the venue to provide safe environment not the act performing. The only contract or guarantee Prince is responsible for to the fans is for a good performance. The end.
