'PRINCE Act' Rushed Before Minnesota Lawmakers to Protect Heirs' Rights

With reporting from Toni Randolph

UPDATED 11 a.m. with bill details.

Minnesota lawmakers are rushing to enact a law that would restrict the use of Prince's name and likeness in commercial ventures, affording more control to heirs of the late musician's estate.

They're dubbing it the PRINCE Act, short for the Personal Rights in Names Can Endure law.........................

It's good that this is happening now because it would put to a halt all of the bootleg items being sold on Facebook with his face and name, we now damn well he would not have endorsed phone cases and jewelry with the symbol on it.

Good, they need to protect his image, and his family should be the ones to have the upper hand on it. I wonder if that includes not being allowed to post images of him on fan sites as well.

"I've had people say, `Is it just prompted by the death of Prince?' Yeah, essentially it is. Really, what it's doing is it's attempting to recognize the right of publicity postmortem," Hoppe said.

Sounds like this could be used against the tabloids to stop all of the speculative stories. Otherwise his image and name would generally already be protected under trademark law.

-/- It would put an end using his face on their covers. I really hope wants everything settles I hope the estate addresses the National Enquier. AIDS is nothing to make fun of it if he had it they could show some compassion. If he did not have they scaring the hell out anyone that was involved with him. Horrible

It's a good thing that will cut down on the sales of shirts cases hats etc..... However if you are enjoying your YouTube flood, hold on to it now because it is the reason this is being pulled up too.

This would definitely meet with Prince's stamp of approval....

We already have laws for this, nationally. Example; in order for me to use the name & or likeness of Elvis Presley for commercial use, I have to first get permission from the estate or I would be liable. Why is Prince different than any other intellectual property?

Why is this a good thing?

The reality is these modern technologies such as google/youtube will allow a new generation of fans to curate his legacy and for a new audience to meet his music. If they start taking stuff off the websites his legacy is over (as us die hards die off).

I hope his family sue the pants off the Enqiurer. I was so disgusted when I saw the front page of the Enquirer in 2 or 3 stores, and newstands defaming Prince in such a horrible, way, upon his death with unconfirmed rumors of his health, and reasons behind the cause of his death.

So in addition to having his own symbol, an entire colour identified with him and heaps of music and imagery, Prince can now be credited with prompting a State Legislature to come up with a law named after him.

-// Using his face to sell the sleazy National Enquier or something stupid like hemroid cream. I am sure the estate will put the music or Goggle and I-Tunes so people will be able to buy it.

Hmmm...I never get a good feeling when laws are "rushed."

They never seem to work out very well.
