Do The Time have their name back?

Prince blocked The Time using the name 'The Time' for their last album in 2011.

I suppose they can now use their band name again?

The thing is that (IMHO) the whole fuss was about ownership of the masters, that belong to WB and that P hoped to get back at some point.

It's unlikely that P's estate will fight WB for the masters of the Time albums now, they're more likely to work with the label for some decent rereleases with unreleased bonus material. And IF the 1997-98 Old Bags New Tricks album does indeed exist it belongs to them and I guess they can release it as The Time regardless of what the other members do, because they'd most likely involve Morris anyway.

It's unlikely that the Original 7ven re-forms too BTW, but who knows... If they did it's unlikely P's estate will get into a fight with them regarding the name but they may also not want to use it out of respect for P's memory, IDK.

Morris Day & The Time are already touring as such, all they could really do is release some live albums under that name since it's unlikely that particular version of the band will ever cut new material.

In the end I don't think no one will care.

I'm pretty sure Morris was only referencing Private Joy with the whole 'Belongs to Prince' thing. He references Prince and Time lyrics a lot on Twitter.

Prince definitely controlled the trademarked to the name 'The Time'. Not sure if his claim would pass on to his heirs.

Well, the chart shows Prince/Jamie Starr as the only member through the whole thing (even when Morris wasn't). But again, it has nothing to do with whether an entity without Prince could record as "The Time" now, or whether they could before.

Absolutely not. Morris Day & The Time were banned from using that name on recordings (though they got away with it on the Jay & Bob Strike Back OST IIRC). This is the reason why their 2004 live album It's About Time is credited to Morris Day only.

That was about money though. They were smart enough to want to all that they were potentialy entitled to, and Prince on the other hand knew The Time was a major pience of his empire, so the stand-off.

It would be nice if Prince's estate sold the rights to the Time name, trademark and unreleased recordings to Jimmy and Terry for a reasonably small amount of money. They would manage it properly, and ensure all original seven members would be compensated for it equally.

Thsi whole "Morris Day and the Time" thing is Morris running the show and getting the lion's share of the profits.

Whether Jesse, Jimmy and Terry ever have interest in performing or doing anything to promote new/unreleased Time material is another matter all together, but I think they would...at least for short periods of time.

If it breaks when it bends, you better not put it in.

Just my opinion, and I don't know for sure, but I HIGHLY doubt Morris wants to split the rights with anyone not named Prince.

Prince controls the name when it relates to the configuration of the band. The Time has been able to use it when it's not the original line up. It's not about Jimmy & Terry. People don't go for decades with bad blood like that. Those are his boys. Any other configuration and they can use it. Notice when Jesse, Jimmy, or Terry left again, and Chance, and Tori, etc. came back, then they were The Time or Morris Day and The Time again. With those other three, they had to be The Original 7ven.

If it's the original line up that Prince put together, that is what he has a say-so in. Same reason The Family can never use their name; they've never had another configuration other than the original 4 members (plus Jerome). Plus, they've fully embraced a new name and moved forward. Paul & Susannah both called Prince to talk to him about using The Family before their sophomore album was coming out. Prince simply said no.

I really doubt if Apollonia 6 had gotten together for something, that Prince would have put the brakes on that, too. They could have called themselves anything else, as a group, and stayed together. But if they worked together as A6, Prince could take issue with it.

I think this is the thing, and I agree it's all about releasing music, touring is a different animal. Albums by the time need Prince's involvement to be genuine.

That said, I always figure if the repeated story of Prince creating The Time for Morris as payment for Partyup is true, then either Morris should get the song back or the band (including the name) should be his. Just sayin'... cool
