I've just had a long and extensive discussion with a Trading Standards officer regarding the posted Web Sheriff email and the situation as a whole

Firstly, regarding images, email Web Sheriff and ask them who owns the copyright on the images they are objecting to

They then have to prove they own the copyright to each and every image

As they don't own the copyright that isn't going to happen

Unless there is a specific contract between a fan and the artist stating that no photography will take place, the copyright to the photograph belongs to the person who takes it

Simply putting "no photography" on the tickets and on signs does not constitute a contract and is therefore insufficient

I also raised the issue of cameras and camera phones being confiscated at shows and returned at the end of the night

This also appears to be legally dubious

Second, should this go to court, you always have the option of serving a subpoena on the artist to ask him, under oath, to explain exactly how the images have damaged his reputation

I would love to hear that explanation

Thirdly, the claim of copyright on the correspondence from Web Sheriff raised a laugh from Trading Standards

The exact words were "it's a bluff"

The same phrase was used in relation to the request for lawyers details in France, Germany, Holland etc

The simple answer should be "I don't have lawyers in those countries, talk to me"

That's the opinion of a Trading Standards officer with 18 years experience

I have considerable access to Trading Standards officers and other experts in the field of copyright and trademark within the UK and should any of the moderators of this site wish any research undertaken I would be more than happy to assist

It won't cost a penny

One last thing, insist on Web Sheriff having an individual sign emails and letters

Simply signing it "Web Sheriff" is ridiculous, how can a company sign a letter or email?

A company doesn't sign, an individual does, and an individual is liable should the correspondence be found to be factually inaccurate, libellous, or malicious

You should insist on a name and their position within the company

Personal liability cuts both ways

cool I hope you sent an orgnote to ben hmmm

Moderators ! this post is seriously damaging your cause !

If someone took your song rehashed it with defamatory words then splashed it all over the WWW would'nt you be a little bit pissed off ?
[Edited 11/7/07 5:09am]

dude, censorship is not cool. Its not up to the moderators to control anyones thoughts or creative expression. People have been making parodies of songs since forever(?), why is prince held to a different standard than anyone else? Sure, he may not like it. Im sure Abe Lincoln's descendants didnt wanna hear "Abraham Lincoln was a racist", but it didnt stop prince from singing it.
Whats next, gag orders getting mailed to Weird Al?

why is prince held to a different standard than anyone else?

Because your not fans of anyone else.

I did'nt suggest the post be removed or edited i just stated it was damaging your cause. I would expect this from a non-fan but not from fan !

Needless to say Prince would definatley have grounds to take down this site based on this song and the many other libelous statements on this site over recent days.

Excuse me, i'm off to play little red corvette for the 3rd time today !

With all due respect, what does that have to do with anything? But for the record, I listen to all types of music. Over the years I've become less and less of a prince head. My musical horizons are vast. I dont get your comment.

No, folk who live on Prince.org are Prince fans ! They may like and appreciate other artist's.

But they are Prince fans.

The passionate respone to this thread proves that.

Long live Prince and Prince.org !

Wrong. You're just wrong. That's like saying Prince is a Sly & The Family Stone fan, but he can't be a James Brown fan as well.

Listening time: Probably more Prince.

Memorablila (outside of music): I have 100 times more MJ stuff than Prince. I don't even LIKE Madonna anymore yet I have more of hers, albeit chucked in corners and cupboards never to be revisited again. Also a stupid amount of Kylie merchandise from my childhood.

Concerts: OK, I've been to more Prince shows than anyone else by a long way, but that's cos he tours more than the rest.

i've come to this conclusion, im not siding with anyone. if there is one thing that is true in this whole battle, it's that we've got to pray for justice to prevail in all of this. i dont know who's lying & who's telling the truth but i pray that the truth comes out and that peace can be made on both sides. it hurts so much to see all of this unfold before my eyes.

whether you are for prince or the fansites, lets unite in praying for a resolution in this situation. please join me in this. pray
I'm not a fan of "old Prince". I'm not a fan of "new Prince". I'm just a fan of Prince. Simple as that

Well I'm not denouncing anything just yet. It's only been 2 days. I'd like to see a response and a resolution before the end of the year at least. I'm certainly not chucking anything out, and if Prince decided to play a 4 hour aftershow in any of our living rooms then we'll see how far our principles take us then... although if it was a straight performance of The Rainbow Children then I think I'd just go to bed neutral

He's run out of enemies, apparently. Everything's freakin' battle with this guy, everyone's a threat, going all the way back: Record Company, band members, the press, Warner Bros., his agent, his lawyer, his girfreinds, Paisley Park employees, MTV, YouTube, Controversy, cover versions of his songs, samples, Housequake.com, file sharers, Mayte, Mani, people/movies who curse, record stores, free expression on message boards, movie soundtracks...

Now we've moved on to tattoos, dancing babies and license plates. It's pretty fucking rediculous, it's old and it's tired. I've never seen a guy who wanted to be left alone SOOOO bad do so much to call attention to himslef. It's truly insane, from sequined clothes and ass-revealing pants, stage humping and name changing, Prince's behavior practically screams "Hey! Look at me!", then the guy has the nerve to complain that people talk about him. I guess he did that Super Bowl show so that no one would see it or talk about him.

My wife and I played Prince music at our wedding, where some people gave us cash gifts...hm...wonder if we owe him a cut?

Right now it's fucking EMBARRASSING to be a Prince fan. I suffered through the Lovesexy cover, the butt pants and the name change

I just read the web sheriffs reply to PFU. My support for Prince stops here. I will never buy an album or concert tickets again if this is not resolved. He's whack and a control freak.

Hope this is what you wanted Prince!

I find no joy in all of this. I have no loyalty to the Org even though I have made many, many friends here. At the end of the day, there is no free speech here either and to ask us to band together under some free speech umbrella is laughable to me.

So let me get this straight, just so I understand the ramifications for free speech here:

By the logic of Prince and his lawyers, sites like "hannitysucks.com", "britneyisinsane.com" and "hillaryisalesbian.org" are all illegal? Extrapolate THAT and apply it to any blog where public or political figures are discussed. This is weak, and extraordinarily petty.

Larry Flynt settled this matter years ago.

Okay: free speech to the extent the mods say so. Is that better?

And rest assured, when you do have an issue here, it will go unaddressed.

You DO know that legally you'd have to prove that it isn't true as well, don't you? Remember when The Mirror had that story about Michael Jackson's hole in his nose? He sued, he sat in a room with a doctor and lawyers to have an examination and prove them wrong. He won. You wanna drop your pants in front of a room of lawyers? biggrin

Surely locking down the first thread and burying it within a subforum is just bowing down to all this crap . How anyone is defending Prince is just a complete joke .

Prince was so much nicer back in the day when he kept his mouth shut and let the music do all the talking

I just wonder what he is going to do when the pennies stop rolling in ? Or indeed will he be of use to his new found friends falloff

I've lost all respect for him, not that I had a great deal of respect for him in recent years anyway as over time I've discovered him to be possibly the most obnoxious musician on the planet, but he's really gone overboard this time. What a moron.

I still dig the Lovesexy sleeve, tho'. biggrin
