that is not at all the case.... and in this case... as I said it was not a violation of the first as CNN argued but of the 5th... So I am still correct in that matter. Just like I was on the ACA when I said the mandate as a fine was illegal... but would be okay as a tax... what I do not get is how a judge can just make up the argument for one side and rule on a basis that was never argued.

My understanding is that the judge did not rule on the First Amendment arguments because he didn't need to. CNN had already prevailed on the Fifth Amendment arguments, so there was no need to go further.

Waste of time...Trump' s ego was bruised because his own appointment ruled against him (shocker). This time around, the judge will probably use the First Amendment ( as per the precedent I mentioned above) and Acosta' s press pass will be restored.

from the bit you posted that case would not apply here. that person was denied on an arbitrary basis... there was a basis to ban jimmy but what the court said was there was no due process and no real standard.



and I am correct the current ruling said he could be banned if there was a set standard and a means of appeal.

Anyone for banning the AR15 must be on the side of the criminal as once banned only criminals will have them.
