Contrary to information we posted earlier, John Travolta's second accuser will NOT be entering mediation with the actor and his legal reps.

A source had said that the attorney's representing the conflicting clients were "working on ground rules for the evidence and procedure" in a "strictly confidential" mediation with a judge.

John Doe #2's lawyer, Okorie Okorocha, has set the record straight and told sources:

"I want a full trial with a private judge. There is no mediation. There'll never be a settlement. I want privacy for sex crime victims."

Marty Singer, of course, is still denying any and all allegations. He poked holes in the first accuser's story, but it doesn't sound like he has figured out a defense plan for the second male masseuse's claims. The legal ace recently said:

"We'll disprove it, but we need specifics first. It's hard to disprove something when you don't have more specific allegations."

Out of all of the allegations being thrown at Travolta, John Doe #2's are by far the most convincing. We're looking forward to what the verdict will be when a judge makes a ruling!

The first man to accuse John Travolta of sexual assault has just filed papers dismissing his lawsuit against the actor ... TMZ has learned.

The masseur had claimed Travolta assaulted him on January 16 at the Beverly Hills Hotel. But as TMZ first reported, flight records show Travolta was in NYC that day ... and was even photographed inside the Greenwich Hotel.

The dismissal papers were filed this morning in California and specifically state that it is only John Doe One who is dropping his claim.

A second masseur -- John Doe #2 -- is still pursuing his claim, which alleges Travolta sexually assaulted him in an Atlanta hotel.

John Travolta's latest defender isn't necessarily the first person he would have chosen - but perhaps he'll appreciate the support nonetheless.

Victoria Gotti, widow of legendary New York gangster John Gotti, launched an impassioned defence of the actor amid claims that he sexually harassed two male massage therapists and a cruise ship worker.

Travolta, 58, is set to play Gotti, known as 'the Dapper Don' in an upcoming film - and his wife said she couldn't care less if the actor is gay or straight.

Defender: Victoria Gotti said she doesn't care about Travolta's sexuality and said he should be left with dignity

'Who the f*** really cares?' she told the New York Daily News.

'Does it make him less of a beautiful human being? No.

'Whatever the true story is, leave him with his dignity.'

Insisting the actor's sexuality did not matter in the grand scheme of things, the mobster's widow took a different position from many of the Don's friends.

A friend of the family Frank Gallano, 57, said Travolta was not the right man to play Gotti, while others feel the allegations make him less plausible as the tough-talking boss of the Gambino crime family.

'If there’s anybody in this world who knows that people make false accusations against someone for their own benefit, it’s John,' Mr Carnesi said.

Junior Gotti was tried four times for racketeering between 2004 and 2009, but each was declared a mistrial when the jury failed to reach a unanimous verdict.

Travolta's real-life wife Kelly Preston is set to play Victoria Gotti in the film, titled 'Gotti: In the Shadow of My Father', and filming is meant to start at the end of the year.

Gotti's son Junior has sided with his mother, and his lawyer Charles Carnesi told the Daily News the Don's son had sent Travolta a letter of support.

Producers Fiore Films have also backed the Pulp Fiction star, claiming they are behind him '110 per cent'.

Travolta himself continues to deny allegations that he grabbed the crotches of two masseurs and masturbated in front of them.

The first man to accuse the actor was dropped by his lawyer, Okorie Okorocha, last Friday when Travolta's legal team produced evidence that he was in New York on the day his accuser said he was attacked in Los Angeles.

Mr Okorocha also represents a second plaintiff, an Atlanta-based masseur, who wants his sexual assault and battery lawsuit to be heard as a full trial with a private judge.

A third man, Fabian Zanzi, has come forward saying Travolta offered him $12,000 for sex while he was working on a Royal Caribbean ship in 2009.

Travolta's lawyers say they have obtained an incident report which shows the story is untrue.

The star, who has two surviving children with his wife Kelly Preston, continues to fight the accusations.

And on top of that they used that picture of her to go with their headline. She was probably blinking when the paps snapped that pic. But they loooooove those kinds of pics with celebrities looking drugged or crazed or angry. Smh.
