Jury awards jailed illegal immigrant $750,000 lottery ticket

A jailed illegal immigrant in Georgia is the rightful owner of a $750,000 lottery ticket, a jury decided Thursday.

The Macon Telegraph has an excellent write-up on the tale of suddenly rich but soon-to-be-deported Jose Antonio “Tony” Cua-Toc, 27, a native of Guatemala who entered the country illegally in 2000.

Cua-Toc, a day laborer in the employ of Fort Valley business owner Erick Cervantes, bought the winning Jingle Jumbo Bucks lottery ticket in November 2010. Cua-Toc said he asked Cervantes to cash in the ticket because he was in the country illegally, but Cervantes kept the money.

Cervantes claims he gave Cua-Toc $20 to buy the ticket for him, but jurors watching store video of an exultant Cua-Toc decided that was not the behavior of a man who had just won a fortune for someone else.

If there was no written agreement between the two, I think the worker is out of luck. Not unless the employer has a good conscious, and give him a piece of the action.

Without knowing any more info, there's no way to know for sure.

But I believe the law is generally set up so that whoever presents the ticket is the winner, regardless of who had it before. That's why they tell you to sign your ticket immediately.

It's doubtful the guy suing is going to get anything out of this.

Aside from the law..................who do u believe?

Aside from the law and based solely on what is posted here. I believe Cervantes.

I do not see any relation between the two that would lead me to believe Cua-Toc trusted Cervantes to collect the lottery winnings on his behalf.

Most states allow anywhere from 6 weeks to 6 months to collect your winnings. That is ample time to get up some adequate documentation to show proof of residence.

Resident or not, we don't know the rule regarding the lottery. Maybe you don't even have to be a citizen or resident to win.

Why couldn't Cua-Toc by his own ticket? Why did he have to give Cervantes the money to purchase the ticket?

My gut tells me neither of them are the rightful owner. They stold the ticket then fought over who should keep the bulk of the winnings and Cervantes told Cua-Toc to fuck off, now we are here.

Trial begins in dispute over $750,000 lottery win

The Telegraph of Macon reports (http://bit.ly/zwUqjS) that jurors in the central Georgia trial must decide whether the ticket belongs to the worker, Jose Antonio Cua-Toc, or his former employer, Erick Cervantes of Warner Robins.

Cua-Toc, a native of Guatemala, says he purchased the winning ticket in November 2010 in Warner Robins. But because Cua-Toc did not have the proper documentation to receive the ticket proceeds, the lawsuit alleges that Erick Cervantes claimed the winnings on Cua-Toc's behalf and then kept the money.

An attorney for Cervantes maintains that he is the rightful owner of the lottery ticket and that Cervantes gave Cua-Toc money to buy the ticket for him.

This is so suspicious...why? because, I'm not sure, but I believe that illegal immigrants cannot legally claim a prize when they win. So maybe they decided to award him the money so the state can keep it since it cannot be paid to him for being illegal.

I belive the winner.
