Halle Berry has had a very successful Hollywood career, however, her love life has been nothing short of a disaster. Berry has been to two failed marriages, the first with former Yankees outfielder David Justice and the second with musician Eric Benet.

However, neither of those exes are giving Berry trouble, it's actually a former beau Gabriel Aubry. Aubry and Berry were together for five years and have a two and a half year-old daughter Nahla.

While their breakup seemed to be peaceful, it's turning out that the battle for custody of their daughter could become heated. "Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her," Berry's rep told FoxNews.com.

In fact, Berry is so concerned that she's decided to pull out of the movie "New Year's Eve" in order to focus on the upcoming hearings. "She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention," said Berry's rep.

Sounds like a lot of trouble could be brewing for Berry and Aubry.

And I believe in Texas, that if that's not established at birth or something that it can be hard to do afterwards.

Here's how it is in Texas, and I'm sure this is pretty standard across the US. I checked and it's pretty much the same in Cali. So if you're unmarried and don't officially establish the kid is legally "fatherless"

hmmm. He's normally the one holding her in their photos together. That doesn't mean much--he's bigger and probably stronger. But he doesn't look like someone to be seriously concerned about.

She has 2 failed marriages already under hear belt. I would think he's at least as 'stable' a parental figure, and joint custody should be the right thing to do. I wonder if the two parents are really concerned about that girl or if the poor thing has become some sort of pawn in a post-breakup smear campaign.

Well, Kim has been dating a New Jersey Nets basketball player for months and she was only seen with Gabriel a few times. So I doubt that has anything to do with the issues right now.

What I can't understand is why the hell didn't they work all this shit out right after the baby was born. Paternity should have been established and they should have thought about what would happen should their relationship not work out. Yeah, yeah, yeah....I know. They were "in love" and thinking they'd always be together. Bullshit!

Having been through two humiliating failed marriages, Halle and her attorneys should have gotten all the t's crossed and the i's dotted on this shit, the moment she found out she was pregnant.

And again, she was on Oprah and was pretty emphatic that when she was ready to get knocked up she'd just ask the dude she was with if he was down with it and if not she'd go another route. ... especially as bad as she was jonesin' for a baby and was very clear that she never wanted a husband again. Shoot, you can find co-parenting agreements in non-traditional families all across Amuurica. Maybe she thought she was going to have one of those common law marriages (I see those in Europe ALOT, and I have one Auntie in Massachusetts whose had on for 30 years )
